3. Marketing
We only send you electronic marketing if you have ticked the box asking for it, or if you are already our customer and the message relates to similar products. Every message carries an unsubscribe link, and you can opt out at any time by replying or by emailing popia@novaxbattery.co.za. Opting out has no effect on your warranty or on any claim.
4. Who we share it with
- The authorised outlet handling your sale, warranty or claim — only what that outlet needs to do the job.
- Our payment provider — to take and reconcile payment. Card details go to them directly, not to us.
- Couriers — delivery name, address and phone number.
- Our hosting, email and IT service providers — under contract, to run the systems this information sits in.
- Our professional advisers, auditors, and a regulator or court — where we are required or entitled to disclose.
We do not sell your personal information, and we do not share it for anyone else's marketing.
5. Information sent outside South Africa
Some of our service providers — hosting, email, analytics — process information outside the Republic. Where that happens we rely on section 72 of POPIA and require, by contract, protection substantially similar to POPIA. Tell us at popia@novaxbattery.co.za if you want the current list.
6. How long we keep it
- Warranty registrations and claims — the warranty period plus three years, so we can deal with a late dispute.
- Sales, invoices and tax records — five years, as tax law requires.
- Enquiries that go nowhere — 12 months.
- Unsuccessful reseller applications — 12 months.
- Marketing consents and opt-outs — for as long as we market, plus three years, so we can prove you asked for it or asked us to stop.
After that we delete it or de-identify it.
7. How we protect it
As section 19 of POPIA requires, we take reasonable technical and organisational steps to keep your information safe — encrypted connections to this site, access limited to people who need it, and contractual security obligations on our service providers. No system is perfect. If your information is compromised in a way that is likely to cause you harm, we will tell you and the Information Regulator, as section 22 requires.
8. Your rights
Under POPIA you may:
- ask what personal information we hold about you, and get a copy (section 23);
- ask us to correct or delete information that is wrong, misleading, excessive, out of date or held without authority (section 24);
- object to us processing your information on legitimate-interest grounds (section 11(3));
- withdraw a consent you gave us, at any time;
- object to receiving direct marketing;
- complain to the Information Regulator.
Email popia@novaxbattery.co.za to exercise any of these. We may ask you to prove who you are first. Formal requests use the Regulator's prescribed forms and we will send you the right one. We respond within 30 days, or tell you why we need longer.
9. Cookies
This site uses only what it needs to work, plus optional analytics. We do not use advertising cookies or cross-site tracking. You can block or delete cookies in your browser; the site will still work, though some things may be less convenient. This site does not store your personal information in your browser.
10. Complaining to the Regulator
