2. Prices and the scrap exchange

  1. Every price on this site is in South African Rand and includes the scrap exchange on your old battery. Prices shown are recommended retail prices and include the scrap exchange on your old battery. The figure shown is the total amount payable at the counter — nothing is added at the till.
  2. Prices are recommended retail prices, current at the date of publication, and may change without notice.
  3. Delivery charges, where they apply, are shown separately before you pay.
  4. Nothing is added at the till. The figure shown is the total amount payable for the battery, its fitment and the scrap exchange.
  5. If a price on this site is obviously wrong — a typing or system error — we are not obliged to sell at that price. We will tell you before we take payment, or refund you in full if payment was already taken, and you are free to walk away.

3. Authorised resellers set their own prices

NOVAX® is sold through Global Batteries Xpress outlets and through independent businesses we appoint in writing. Those resellers are not our agents and we do not control what they charge. The price shown here is a recommendation only. An authorised reseller is free to sell above or below it, and nothing in a NOVAX® appointment obliges a reseller to sell at any particular price.

4. Buying online

  1. An order placed on this site is an offer to buy. A sale is concluded only when we accept the order and payment clears.
  2. Card payments are processed by our payment provider on their own secure pages. We do not receive or store your full card details.
  3. You receive an invoice for every sale. Keep it — it is the document that proves your warranty period.
  4. We will confirm your order by email. If we cannot supply what you ordered, we will tell you and refund you in full.
  5. Risk in the battery passes to you on delivery or collection. Ownership passes once we have received payment in full.
  6. Batteries are heavy and are classed as dangerous goods for transport. Some couriers will not carry them and some areas cannot be served. Where we cannot deliver, we will arrange collection from an authorised outlet or refund you.
  7. Check the battery on delivery. Tell us within 48 hours if it arrived damaged, and keep the packaging.

5. Changing your mind — the 7-day cooling-off right

Because you bought online without seeing the goods, section 44 of the Electronic Communications and Transactions Act gives you a cooling-off right.

  1. You may cancel an online purchase within seven days after you receive the battery, without giving a reason and without penalty.
  2. Tell us by email at info@novaxbattery.co.za and return the battery to us or to an authorised outlet.
  3. You pay only the direct cost of returning it. We refund the purchase price within 30 days of the cancellation.
  4. Please do not have the battery fitted if you think you may cancel. A battery that has been fitted and put into service cannot be resold as new, and we may reduce the refund by the amount of that loss. This does not apply if the battery is faulty — in that case section 6 below and the warranty apply, and you are not out of pocket.

6. Returns, faults and refunds

  1. Faulty or not as described. Under sections 55 and 56 of the Consumer Protection Act 68 of 2008, for six months after delivery you may return a battery that is not of good quality, not free of defects, or not reasonably fit for its normal purpose, and you choose a refund, a replacement or a repair. You do not pay to return it. This right is separate from, and in addition to, the NOVAX® warranty.
  2. Wrong size ordered. If you ordered the wrong size and the battery is unused, unfitted and in its original condition, we will exchange it. Where the exchange is not covered by the cooling-off right above, a handling charge may apply and will be told to you first.
  3. After six months. The NOVAX® warranty applies for the remainder of the 12, 18 or 26-month period for your range.
  4. Refund method. Refunds go back to the account or card used to pay.

7. Using this website

  1. The information here is provided in good faith for general use. Battery sizes, ratings and vehicle applications must be confirmed at an authorised outlet before you buy — do not rely on this site alone to choose a battery.
  2. Do not use this site unlawfully, do not attempt to interfere with it, and do not scrape, copy or republish its content or prices without our written permission.
  3. We may change or take down any part of this site at any time.
  4. Links to other sites are for convenience. We are not responsible for their content.

8. Trade marks and content

NOVAX®, the NOVAX® logo and the Global Batteries Xpress logo are trade marks of their respective owners. The text, layout, artwork and photographs on this site are protected by copyright. Nothing on this site gives you a licence to use any of it. Vehicle makes and models are referred to for identification only; we are not connected with, and do not imply endorsement by, any vehicle manufacturer.

9. Liability

  1. We do not exclude or limit our liability under section 61 of the Consumer Protection Act for harm caused by unsafe or defective goods, nor our liability for death or personal injury, fraud, or our own gross negligence. Any part of these terms that attempted to do so does not apply.
  2. Subject to that, we are not liable for indirect or consequential loss arising from the use of this site or from a battery failure — for example towing, car hire, lost income or missed appointments.
  3. Nothing in these terms waives, limits or attempts to contract out of any right you have under the Consumer Protection Act.

10. Complaints and disputes

  1. Raise a complaint with the outlet first. If it is not resolved, email info@novaxbattery.co.za with the invoice number and what happened. We acknowledge within two business days.
  2. If we cannot resolve it, you may refer the matter to the National Consumer Commission, to a consumer court in your province, or to an accredited consumer goods ombud.
  3. Nothing here requires you to give up any of those routes, or to go to arbitration instead of them.
  4. These terms are governed by the law of the Republic of South Africa.
